1 This is particularly unfortunate because in deciding to set aside the demand the judge exercised a discretion , and on this appeal I am discharging an appellate jurisdiction and not hearing the matter afresh and exercising my own discretion : see In re Gilmartin ( A Bankrupt ) [ 1989 ] 1 W.L.R. 513 .
2 The court may set aside the demand if the debtor appears to have a counterclaim , set-off or cross claim equalling or exceeding the debt demanded , the debt is disputed on grounds which appear to the court to be substantial , the creditor appears to hold some security for the debt of sufficient value , or the court is satisfied on other grounds that the demand ought to be set aside .
3 The possibility that the amount of the bills might be reduced on a taxation which has still not been initiated is not a sufficient reason in this case for setting aside the demand .
4 Doing so , my overall conclusion is that for the reasons set out above there do not exist here sufficient grounds for setting aside the demand .
