1 For the purposes of sections 60 , 61 and 62 of the Banking Act 1987 the definition of deposit in section 5 of that Act shall be treated as excluding any sum to which a person becomes entitled ( otherwise than by operation of law ) , or comes to be treated as entitled for the purposes of sections 58 and 60 of that Act , after a petition is presented by the winding up of the institution , or , in the case of an institution in respect of which such a petition has been presented before the date on which this Order comes into force , 30 July 1991 .

17 In my opinion a tenant in that position , that is to say where an absolute order for possession has been made against him , notwithstanding that it may be suspended , is not a tenant for the purposes of section 12(1) ( g ) .
18 The question whether the involvement of the solicitors in the manner pleaded in the four sub-paragraphs is sufficient to make them ‘ knowingly concerned ’ for the purposes of section 6(2) or section 61(1) of the Act has not been addressed .
