1 In the latest edition of his Principles of Family Law , Professor Cretney repeats the argument that the use of the words ‘ male ’ and ‘ female ’ in section 11(c) of the Matrimonial Causes Act 1973 ( which repealed and reproduced the provisions of the Nullity Act 1971 ) , suggests that it ‘ may thus be possible to argue that the terms ‘ male ’ and ‘ ‘ female ’ refer to a person 's gender ( that is to say , the sex to which he psychically belongs ) ’ .

3 The disposal of such dwelling house within three years ( Housing and Planning Act 1986 , s2(3) ) from the date of purchase " triggers " repayment of the discount on the proportion still outstanding by reference to the number of years since purchase but s160(1) ( c ) of the Act , specifically exempts from the repayment provisions disposals in pursuance of an order under s24 of the Matrimonial Causes Act 1973 , where continued occupation is envisaged ( see R v Rushmoor Borough Council ex p Barrett [ 1987 ] 1 All ER 353 ) .
4 Order 6 , r 5 provides that in mortgagee possession actions — that is where the plaintiff claims payment of money secured or possession of the property mortgaged — the particulars of claim must state : ( 1 ) the date of the mortgage ; ( 2 ) the state of the account , giving particulars of the amount of the advance , the periodic payments required , the amount of any interest in arrear , the amount of the unpaid instalments , the amount of any costs or fines or insurance unpaid ; the daily rate of interest and the amount remaining due under [ and required to redeem ] the mortgage ; ( 3 ) what proceedings ( if any ) the plaintiff has taken against the defendant in respect of the money secured by the mortgage or the mortgaged property and , where payment of such money only is claimed , whether the plaintiff has obtained possession of the property ; ( 4 ) where the plaintiff claims possession of the property , whether or not the property consists of or includes a dwelling house within the meaning of s 21 of the County Courts Act 1974 ; ( 5 ) where a plaintiff claims as mortgagee possession of land which consists of or includes a dwelling house , he shall state , in his particulars of claim , whether there is any person on whom notice of the action is required to be served in accordance with s 8(3) of the Matrimonial Homes Act 1983 and , if so , he shall state the name and address of that person and shall file a copy of the particulars of claim for service on that person ( Ord 6 , r 5(1A) ) .
5 If the search reveals an existing land charge Class F or a caution , notice shall be given by the mortgagee ( s 8(3) of the Matrimonial Homes Act , 1983 ) .
6 Where a mortgagee claims possession a person who has registered a land charge , notice or caution under s 2(7) of the Matrimonial Homes Act 1967 or a notice under s 2(8) of the Matrimonial Homes Act 1983 must be served with a copy of the particulars of claim ( Ord 6 , r 5(1A) ) .
